     A bill to create the Father Marquette national memorial and

 

Mackinac straits area museum advisory board; and to prescribe the

 

powers and duties of certain state agencies and officials.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"Father Marquette national memorial and Mackinac straits area

 

museum advisory board act".

 

     Sec. 2. As used in this act:

 

     (a) "Advisory board" means the Father Marquette national

 

memorial and Mackinac straits area museum advisory board created by

 

section 3.

 

     (b) "Department" means the department of natural resources.

 

     (c) "Museum site" means the site of the Father Marquette

 

national memorial and Mackinac straits area museum.


 

     Sec. 3. (1) The Father Marquette national memorial and

 

Mackinac straits area museum advisory board is created within the

 

department.

 

     (2) The advisory board shall consist of the following members:

 

     (a) One member appointed by the speaker of the house of

 

representatives.

 

     (b) One member appointed by the senate majority leader.

 

     (c) Nine members appointed by the governor, including all of

 

the following:

 

     (i) One representative from the city of St. Ignace.

 

     (ii) One representative from the township of Moran.

 

     (iii) One representative from the county board of commissioners

 

of the county of Mackinac.

 

     (iv) One representative from the Michilimackinac historical

 

society of the county of Mackinac.

 

     (v) One representative from the Sault Ste. Marie tribe of

 

Chippewa Indians.

 

     (vi) Three members from the general citizenry of the state, at

 

least 1 of whom is a resident of the Upper Peninsula.

 

     (vii) One representative from the Mackinac Island state park

 

commission.

 

     (3) Each member of the advisory board shall be a registered

 

voter and a resident of this state.

 

     (4) Not more than 6 members of the advisory board shall be of

 

the same political party.

 

     (5) A member of the advisory board appointed by the speaker of

 

the house of representatives or the senate majority leader under


 

subsection (2)(a) or (b), respectively, shall hold office for a

 

term of 2 years to coincide with the term of office of state

 

representative. Except for members first appointed, the term of

 

office of each member of the advisory board appointed under

 

subsection (2)(c) shall be 4 years. Of the members of the advisory

 

board first appointed under subsection (2)(c), 3 shall serve for 4

 

years, 3 shall serve for 3 years, and 3 shall serve for 2 years.

 

Vacancies on the advisory board shall be filled in the same manner

 

as the original appointment for the remainder of the unexpired

 

term.

 

     (6) A member of the advisory board shall serve without any

 

compensation. However, members of the advisory board may be

 

reimbursed for their actual and necessary expenses incurred in the

 

performance of their official duties as members of the advisory

 

board.

 

     (7) The members of the advisory board annually shall elect a

 

chairperson, vice-chairperson, and secretary.

 

     (8) The advisory board shall meet not less than twice each

 

calendar year at the call of the chairperson. A majority of the

 

members of the advisory board shall constitute a quorum for the

 

transaction of business.

 

     Sec. 4. The advisory board shall do all of the following:

 

     (a) Advise the department of the policies, plans, and programs

 

concerning the museum site.

 

     (b) Facilitate cooperation between the department and public

 

and private entities interested in historic preservation at the

 

museum site.


 

     (c) Encourage donations of real and personal property to the

 

department for purposes incidental to, or connected with, the

 

museum site, including artifacts associated with the park.

 

     (d) Promote public use of the museum site.

 

     (e) Advise the department and other appropriate authorities on

 

maintenance and expansion of the museum site.

 

     (f) Apply for grants and seek other sources of funding to

 

support the museum site.

 

     Sec. 5. The business which the advisory board may perform

 

shall be conducted at a public meeting of the advisory board held

 

in compliance with the open meetings act, 1976 PA 267, MCL 15.261

 

to 15.245. Public notice of the time, date, and place of the

 

meeting shall be given in the manner required by that act.

 

     Sec. 6. A writing prepared, owned, used, in the possession of,

 

or retained by the advisory board in the performance of an official

 

function shall be made available to the public in compliance with

 

the freedom of information act, 1976 PA 442, MCL 15.231 to 15.246.
