A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding part 92.
the people of the state of michigan enact:
SOIL HEALTH AND CONSERVATION
Sec. 9201. As used in this part:
(a) "Bulk soil" means a soil product available for purchase in bulk quantities, typically sold by cubic yard.
(b) "Class 1 compostable material" means that term as defined in section 11502.
(c) "Potting soil" means a substrate product available for purchase for planting and growing for horticultural or agricultural purposes, typically packaged and sold in quantities of 1 cubic yard or less, and that may consist of a combination of organic and inorganic material to provide necessary aeration, nutrients, drainage, or pH balance to facilitate plant growth. Potting soil includes, but is not limited to, peat moss, sphagnum peat moss, bark, perlite, vermiculite, coir, fertilizer, or wetting agents.
(d) "Prepackaged soil" means a soil product packaged and available for purchase, typically sold in quantities of 1 cubic yard or less, that may consist of a combination of organic material, water, air, and minerals including, but not limited to, sand, silt, or clay.
Sec. 9203. Beginning January 1, 2027, bulk soil, prepackaged soil, and potting soil sold or offered for sale in this state must contain at least 5% compost derived from class 1 compostable material.
Sec. 9205. Beginning January 1, 2027, bulk soil, prepackaged soil, and potting soil sold or offered for sale in this state must have a label printed in 12-point bold type that states the percentage of class 1 compostable material contained in the bulk soil, prepackaged soil, or potting soil, and all of the information required under section 11563(1). If a label is not feasible, the product receipt or delivery receipt must contain a notice printed in 12-point bold type that states the percentage of class 1 compostable material contained in the bulk soil, prepackaged soil, or potting soil, and all of the information required under section 11563(1).
