CONVEYANCE; LIVINGSTON COUNTY S.B. 478:
SUMMARY OF BILL
REPORTED FROM COMMITTEE
Senate Bill 478 (as reported without amendment) (Senate-passed version)
CONTENT
The bill would authorize the State Administrative Board to transfer administrative jurisdiction of a State-owned parcel measuring approximately 93 acres in Green Oak Township in Livingston County from the Department of Corrections (MDOC) to the Department of Military and Veterans Affairs (DMVA).
The parcel is a portion of the site of the former Maxey Boys' School complex, which was acquired by the MDOC from the Department of Health and Human Services and now contains the MDOC's Woodland Correctional Facility. Woodland Correctional Facility is located on a portion of the larger Maxey site that would not be affected by this conveyance, and the MDOC has indicated that it has no plans to use this particular parcel.
BRIEF RATIONALE
While the MDOC has indicated that it has no plans for the parcel in the bill, the DMVA has indicated that it could use the parcel as a readiness center for the Michigan National Guard at some future date. Under Federal guidelines, the DMVA must obtain administrative control of the property before the site can be considered for Federal funding toward the construction of a readiness center, and so the transfer of jurisdiction has been suggested.
PREVIOUS LEGISLATION
(This section does not provide a comprehensive account of previous legislative efforts on this subject matter.)
The bill is a reintroduction of Senate Bill 440 from the 2023-2024 Legislative Session. Senate Bill 440 passed the Senate and was reported by the House Appropriations Committee but saw no further action.

FISCAL IMPACT
The bill would create some minimal transaction costs associated with the transfer of administrative control of the parcel from the MDOC to the DMVA; however, since the State would be the party on both sides of the transaction, there would be no sales proceeds or purchase cost associated with the conveyance.
If the conveyance were approved and the DMVA received approval from the Department of Defense to proceed with the construction of a readiness center at the site, further action from the Legislature would be necessary to appropriate Federal funds that would be received to support the construction of the readiness center. Because the facility would be considered a military facility, no State matching requirement is anticipated.
