CONTENT
The bill would amend the Michigan Vehicle Code to allow a judge of a driving-while-intoxicated sobriety court (specialty court) to waive the mandatory 45-day license suspension for an individual qualified to receive a restricted license for participation in a specialty court interlock program.
BRIEF RATIONALE
The Code requires the Secretary of State (SOS) to suspend an individual's drivers license if the individual violates the prohibition against operating while intoxicated. For a second offense, the SOS must suspend the individual's license and, after 45 days, issue the individual a restricted license for participation in a specialty court interlock program. The program requires participants to install ignition interlock devices in their vehicles to measure their breath alcohol content each time before driving. According to testimony, the 45-day delay does not stop some individuals from driving to places like work to continue making a living. Testimony also indicates that the interlock program is successful in correcting drunk drivers' illegal behavior. Accordingly, allowing a judge to waive the mandatory 45-day suspension so individuals could enter the interlock program quicker has been suggested.
